Terms and conditions of sale, business customers
These terms govern all sales made by JapHunter Sàrl, Switzerland, through JapHunter B2B. They apply exclusively to business customers acting in the course of their trade. This store does not sell to consumers, and consumer protection rules, including any statutory right of withdrawal, do not apply.
1. Accounts
Ordering requires an approved business account. We verify company registration before approval and may refuse or withdraw an account at our discretion. You are responsible for keeping your registration and VAT details current.
2. Prices and minimum order
Prices are quoted excluding VAT and excluding transport, import duties and import taxes. Prices reflect the market on the day the order is placed and are updated daily. A price shown at the time of order applies to that order only. We do not adjust orders retroactively when a market price moves after purchase, in either direction.
The minimum value of any order is 1,000 CHF, excluding transport and import charges. Orders are invoiced in Swiss francs. Where your own currency differs, your bank applies its own conversion at settlement.
Certain references are sold in fixed multiples rather than by the unit. Where that applies, the minimum quantity and the order multiple are stated on the product page.
3. Orders and confirmation
An order placed on this site is an offer to purchase, not a concluded contract. Every order is checked against our available stock before confirmation. We will either confirm the order, in which case the contract is formed, or cancel it in full or in part if the goods are not available. No payment is captured before confirmation.
4. Payment
Payment is due before dispatch. Bank transfer against invoice is the standard method. Card payment can be arranged: card payments are authorised at the time of order and captured only once availability is confirmed. Where a card authorisation cannot be captured within its validity period, the order is cancelled.
Goods remain our property until payment has been received in full.
5. Preorders
Preorders are firm and cannot be cancelled. When you place a preorder, we commit the corresponding quantity at that day's price, and that commitment cannot be reversed. Release dates announced by publishers are indicative and may move. A postponed release is not grounds for cancellation.
6. Delivery
All shipments are made DAP (Incoterms 2020) from Japan. Import formalities, duties and import VAT rest with the recipient. Delivery times are indicative and not contractual. We are not liable for delays caused by carriers, customs authorities or force majeure.
7. Claims and returns
Shipments must be inspected on receipt. Claims for shortages, transport damage or incorrect items must reach us within seven calendar days of delivery, with photographs of the outer packaging and contents. Beyond that period the delivery is deemed accepted.
We do not accept returns for reasons other than a defect, a shortage or an error on our part. Sealed product must be returned unopened and in its original condition.
8. Authenticity
All product supplied is genuine, factory-sealed and sourced through authorised channels. We do not deal in counterfeit, resealed or repackaged product.
9. Liability
Our liability is limited to the invoiced value of the goods concerned. We are not liable for indirect or consequential loss, including loss of profit or loss of resale opportunity.
10. Governing law
These terms are governed by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the registered seat of JapHunter Sàrl in Switzerland.
